What’s the point of this repository?
Transparency is vital to the operation of justice systems in a democracy.
Tribunal policies reflect how tribunals interpret and apply statutory, common/civil and constitutional law. They provide tribunal members, staff, parties, representatives and the public with guidance and explanations of how the tribunal does its work.
There are hundreds of tribunals across Canada, and thousands of tribunal policy instruments. Most policy instruments are specific to the statutory mandate of an individual tribunal, making them of limited interest for other tribunals.
The purpose of this repository is to identify those policy instruments that are generic enough to be adapted and used by other tribunals. The aim is to use our collective wisdom to work more effectively, by not duplicating efforts in the development of policies. It is also to improve administrative justice by making it easy for tribunals to improve and build on work that others have already done.
We have used the following criteria to include policies in this repository:
- We have only drawn on policies from tribunals that have an adjudicative function in their mandate.
- We have tried to identify policies that embody administrative justice values of accessibility, flexibility and informality. Policies which have a judicial justice tone or content have been left out.
- We have tried to identify policies that other tribunals might easily copy, adapt, or consider when developing their own policy.
- We have not included tribunal rules of practice, forms or user guides, as these are generally too specific to the practices of individual tribunals to be of broader interest.
- There are some instances where a policy has been selected not because of its unique interest, but just because it is typical. In other words, it is a good example of a standard approach that many other tribunals have also adopted.
- There are some instances where the policy is one of a kind, and represents a novel approach that other tribunals have not adopted.
The repository is curated. There is an element of subjectivity in the selection. There are likely policies we have missed. We want this to be a living document.
